The Chief Electoral Officer is also responsible for the supervision of local government elections under the Local Government Act 1993. The Tasmanian Electoral Office (TEO) is the State electoral administrative body under the direction of the Chief Electoral Officer. The Tasmanian Electoral Office takes very seriously the right of all electors to cast a valid vote, and takes the view that electors are entitled to participate as fully as possible in the electoral system. This submission focuses on issues that relate to accessibility of electoral processes in the Tasmanian context. Access to information about the electoral process Tasmanian parliamentary elections One of the statutory functions of the Chief Electoral Officer under the Electoral Act 1985 is to promote public awareness of electoral matters by means of educational and information programs and by other means. The challenge of public awareness campaigns is to get readily accessible electoral information out to as many electors as possible, and to meet the information needs of different groups of electors, within the financial resources available. During election periods, TEO public awareness advertising is run on television, in daily newspapers and on radio, providing advice from how to enrol to vote to the location of polling booths. The TEO has a freecall telephone enquiry service that is widely promoted in all advertising and an email address. Since the 1998 State elections, electoral information has also been available on the TEO web site. It is anticipated that the web site will be developed further, as resources allow, as a means of providing a wider range of electoral information to the public. During Tasmanian Legislative Council (upper house) elections, information brochures are sent to every elector on the electoral roll within the relevant division. These brochures contain information on the elections, polling day, voting by postal vote and locations of polling places. Polling places which contain voting facilities suitable for use by the disabled with assistance are indicated. (Refer to access to polling places below.) Outside election periods, information is available from TEO offices or from the web site. Local Government elections Under the Local Government Act 1993 all local government elections in Tasmania are held by postal ballot. The postal ballot material contains ballot paper(s) and an information brochure containing voting instructions and statements provided by candidates. The Act provides that the Chief Electoral Officer may promote public awareness and understanding of elections, and encourage enrolment and voting. The Chief Electoral Officer is required under the Act to place several prominent statutory advertisements in the three daily Tasmanian newspapers. For local government elections the TEO utilises television, newspaper and radio in the public awareness advertising campaign, with a strong emphasis on its freecall telephone enquiry service. In 1999 for the first time at local government elections, information, including individual council information and the election timetable, was available on the TEO web site. General comment As with any process of providing information to the public, difficulties can be encountered. While electoral information provided to the public is frequently reviewed by the TEO, it may not always be possible to foresee specific problems which people encounter with accessing the information. Electoral bodies such as the TEO need to be aware of any access difficulties encountered by electors so that the processes for providing information can be reviewed and, wherever possible, access to that information improved. Physical access to polling booths Tasmanian parliamentary elections Tasmanian parliamentary elections are conducted by attendance voting at polling places on a set polling day. Although postal voting is readily available to electors who are unable to attend a polling booth for reasons such as distance, disability, health or age, this may not be a consideration if a disabled elector specifically wishes to vote in person at a polling booth. During the 1998 Tasmanian State elections there were 328 polling places throughout the state, 204 of which were advertised as having wheelchair access availablelevel access from car-park or low-gradient ramp. Access to polling booths is assessed by the Returning Officer, who in Tasmania is also the relevant Commonwealth Divisional Returning Officer. Assessment is in accordance with the guidelines of the Australian Electoral Commission. The polling places used for parliamentary elections are the same as those used by the Commonwealth in Federal elections wherever possible to reduce confusion to electors. The same wording in the advertising of those polling places in newspapers is used. The TEO would always examine better premises should they be available. Local Government elections Voting in local government elections is not compulsory in Tasmania. All local Government elections have been held by postal voting since 1994. Access to the voting process by people with vision, literacy & cognitive disabilities Tasmanian parliamentary elections The Electoral Act 1985 currently provides for assistance to be given to electors whose sight is so impaired, or who is physically incapacitated or is so illiterate that he or she is unable to vote without assistance. Under section 130 of the Act, such an elector may appoint a person to assist him or her to complete the ballot paper on his or her instructions. This raises the issue of an individuals wish to reserve the right to fill in their own ballot paper without having to resort to having someone do it for them. However, this in turn also raises practical and privacy issues involved in the provision of a range of special ballot papers. For example larger ballot papers for the visually impaired would be notably different from the majority of ballot papers, and due to the small numbers the secrecy of these votes would be seriously jeopardised in the counting process, particularly at the local booth level. There are other legislative requirements that result in practical problems. For example, in Tasmania the Electoral Act 1985 requires the rotation of candidate names on ballot papers in Tasmanian Parliamentary elections. There were 64 different ballot papers produced for the 1998 House of Assembly elections. Should difficulties be encountered by electors, the TEO would be open to discussions with any individuals or organisations to further assist them or their members to vote while maintaining the secrecy of each vote as far as possible. Local Government elections Section 291 of the Local Government Act 1993 provides that the Chief Electoral Officer may approve any procedures that are reasonable and appropriate to assist an elector whose sight is so impaired or who is so physically incapacitated or illiterate that the elector is unable to vote without assistance. The broad wording of this provision allows flexibility in assessing requests made under section 291 on an individual basis. General The TEO tries to ensure that it is highly accessible to all requiring special attention on the basis of disability, and has generally responded to requests on a case by case basis. The TEO has received one written complaint during the previous 10 years, which related to a need for an enlarged ballot paper during the 1998 State election. This complaint was not received by the Human Rights & Equal Opportunity Commission, or the TEO, until after the election. The TEO indicated at that time a willingness to pursue further avenues with the individual or the Royal Society for the Blind, in an attempt to assist visually impaired electors at future elections. Conclusion In addition to the issue of access to voting, the TEO acknowledges the importance of access to the whole electoral process including access to tally rooms and scrutinies. If an elector encounters, or expects to encounter, difficulties with access to the electoral process, the relevant electoral body needs to be aware of the difficulties in order to review the system and address the problem wherever possible. In addressing such problems however, there can often be practical and privacy issues competing with access issues. Electoral bodies cannot work in isolation to improve access to electoral procedures for those with disabilities. Where problems exist it is important for electoral bodies to work together with those electors to ensure appropriate and acceptable access is achieved.
