All the following are documented cases that have been ignored by the organisation set up to over see the rehab of injured workers, namely Workcover. Rehab company places worker in job trial knowing the worker needs to drive to the job but has a medical restriction preventing him from driving. No attendance means instant halt on all benefits to the injured worker. CGU not able to perform their obligations under the JPP program because they do not understand it (several documented cases) Rehab companies trying to intimidate GP's into reducing or even eliminating work restrictions for injured workers when medical evidence is very much against any review. Rehab company does not bother to try to convince the GP to lift restriction, it proceeds to eliminate the restrictions in the RTW plan with out notifying any onethat the changes have been made. They then promptly close the case when everything degenerates, knowing the injured worker is about to have their employment terminated. Injured worker goes to WCC, only to be intimidated firstly by opposing lawyer then in the second case, by the person supposedly mediating the proceedings. Complaints to IPEA about harassment by employer, rehab companies altering paperwork with out authority and insurance companies inability to perform basic functions of their obligations under Workcover go undocumented and un-investigated. Workcover cannot even confirm that the person existed or kept records of other cases investigated. Insurance companies taking 11 weeks from when they were notified that employment was being terminated, to the time the first payment of make up pay was despatched. As per previous history, the payment was wrong and when this issue was raised with CAS they were unable to explain why. This is only a small part of a documented history of a total neglect of the duty of care by Workcover and its hangers on. In 6.5 years of trying to resolve some of these issues only the ombudsman's office took the time to try to resolve these issues but seem only to be interested if I could present a comprehensive legal claim to them. If they think they have financial restrictions, I am nearing bankruptcy. Case in point is they quote many facts about how well the system works, but have never taken an exit pole of workers leaving the system to see if they were successful or have dropped out in shear frustration. Another point being Insurance companies are permitted to "Dr shop" until they get an opinion they like, but an injured worker does not. An injured worker gets financially penalised for non compliance were as an Insurance Company, rehab company or government department goes "scot free" I would very much be interested in addressing your working party to shed some light on the gloomy underbelly of the system.
